1. Introduction

These Terms & Conditions ("Terms") govern your access to and use of Torziva ("Service"), a web-based SaaS platform owned and operated by Suman Gorai under the brand name Torziva. By accessing or using the Service at https://www.torziva.site, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

2. Description of Service

Torziva is a digital SaaS platform that enables eCommerce store owners to integrate a virtual "Try Now" button on their product pages for supported product categories (such as apparel, sunglasses, and jewellery). The Service is entirely digital in nature and does not involve the sale, delivery, or fulfilment of any physical goods.

The Service includes:

• A JavaScript widget for integration into eCommerce stores
• Virtual try-on technology for supported product categories
• A dashboard for managing settings, analytics, and billing
• API access for advanced integrations

3. Account Registration

To use Torziva, you must create an account and provide accurate, complete, and current information. You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access or security breach

4. Subscription & Payment

4.1 Plans & Pricing

Torziva offers clearly defined subscription plans: Free ($0/month – 10 try-ons), Starter ($29/month – 100 try-ons), and Pro ($99/month – 1,000 try-ons). Current pricing and feature details are available on our website and may be updated from time to time with prior notice.

4.2 Billing

Subscriptions are billed on a recurring monthly basis in advance. By subscribing, you authorise us to charge your chosen payment method on a recurring basis. All payments are processed securely through our third-party payment provider, Paddle, who acts as Merchant of Record.

4.3 Credits

Try-on credits are consumed per use. Monthly credits reset at the start of each billing cycle. Additional credit packs may be purchased separately and are valid for 12 months from the date of purchase.

4.4 Refunds

We offer a 14-day unconditional money-back guarantee on all subscription plans and credit purchases. You may request a full refund within 14 days of purchase for any reason. For complete details, please refer to our Refund Policy.

4.5 Cancellation

You may cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of the current billing period. If you cancel within the first 14 days, you are eligible for a full refund.

5. User Responsibilities

As a user of Torziva, you agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws
• Not upload harmful, offensive, infringing, or inappropriate content
• Not attempt to bypass usage limits, security measures, or access controls
• Not interfere with or disrupt the Service or its infrastructure
• Not reverse engineer, decompile, or disassemble any part of the Service
• Not resell, redistribute, or sublicense the Service without prior written authorisation
• Ensure that your use of the widget complies with privacy regulations applicable to your end-users

6. Intellectual Property

Torziva and all related content, features, technology, branding, and functionality are owned by Suman Gorai and protected by applicable copyright, trademark, and intellectual property laws.

You retain ownership of your store content and product images. By using the Service, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the Service.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TORZIVA AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

In no event shall our total aggregate liability exceed the amount you have paid to Torziva in the twelve (12) months preceding the event giving rise to the claim.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted, timely, or error-free
• Results generated will be accurate or reliable
• The Service will meet your specific requirements

9. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, if:

• You breach any provision of these Terms
• Your use of the Service poses a security risk or may cause harm to other users
• You engage in fraudulent, abusive, or illegal activity
• Your account remains inactive for an extended period

Upon termination, your right to use the Service ceases immediately. Any outstanding fees remain payable.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
